| Loan type | What the bank lends against | Usually fits |
|---|---|---|
| **LAP** (this page) | Property value + what your income can repay | Owner-used house, shop, office or factory; weak or mixed rent |
| **[LRD](/lease-rental-discounting-chennai/)** | Rent a company tenant will still pay into escrow | Strong company lease, registered, lock-in covers most of the loan |

| Where to borrow | Usually suits | What to watch |
|---|---|---|
| **Bank** | Clean title and plan; income fully shown in ITRs and financials | Stricter rules on property type, location and approvals; usually lower cost |
| **Finance company or housing finance** (RBI-registered) | Income clearer in banking or GST than in ITR; wider property types; faster process | Usually a higher rate or a lower share of value — compare the Key Facts Statement |
| **Private finance** (individuals, unregistered) | Short-term needs when a regulated lender will not lend | Not under RBI bank/finance-company rules; get every term in writing; check registration first |

**Tamil Nadu cost to note:** when the bank takes your original title deeds as security (MODT), stamp duty is **0.5% of the loan, capped at ₹40,000**, and registration fee is **1%, capped at ₹8,000** (from 3 May 2024). Confirm with the Sub-Registrar.

## LAP vs LRD: which fits a Chennai commercial property?

Process-only ₹ ranges for discussion — **not** a rate card and **not** a sanction. The bank decides. Illustrative pack: [Loan File Evidence Report](/loan-file-evidence-report/).

| Question | Loan Against Property (LAP) | Lease Rental Discounting (LRD) |
|---|---|---|
| What repays the loan? | Business or professional income (rent may count) | Contracted rent through bank escrow |
| What sizes the amount? | Property value (LTV) and FOIR / income limit | Discounted net rent, capped by property value |
| Illustrative ticket talk-band | About ₹5–25 crore common discussion band (practice also reviews larger) | About ₹5–40 crore when rent and lock-in are strong |
| Illustrative LTV / cap sketch | Often ~50–65% of assessed value on published personal-LAP style bands; commercial/industrial often lower | Lower of rent-cap (e.g. ~80–90% of PV of net rent) and property-cap (often ~50% of value) — lender-specific |
| Illustrative tenure sketch | Often about 10–15 years on term LAP (lender policy) | Often aligned to remaining lock-in / counted rent years (commonly ~5–10) |
| Tenant quality | Secondary | Critical (company tenant + lock-in) |
| Typical fit | Owner-used or weakly leased property | Strong corporate lease on office, shop or warehouse |
| Bank vs NBFC (process fact) | Banks usually want clean title + full ITR; NBFCs may accept wider surrogates at different price/LTV | Same escrow discipline; programme labels differ — compare Key Facts Statement |

Apply now, or fix my papers first?

## Should I apply for a Loan Against Property in Chennai now, or fix my documents first?

Apply now when the property papers, your income papers and the amount you need all line up. Fix first when any one of them does not.

Applying now usually works when **all** of these are true:

- the **title chain** runs unbroken from the earliest parent document to you, and the **encumbrance certificate (EC)** shows every transaction in that chain and no unexplained mortgage or sale;
- the **patta** is in your name and matches the survey number and extent in your sale deed;
- the building has an **approved plan** (CMDA, DTCP or the local body) and, where the rules require one, a **completion certificate**, and what is built matches the approval;
- **every owner** of the property can join the loan as a co-borrower (many lenders require this; see Sources for one published rule);
- your **ITR, GST returns and bank statements** tell one consistent story and support the EMI;
- the amount you need is within **both** the lender's loan-to-value limit (share of property value) and the limit your income supports;
- your **credit report** has no recent overdues and no run of fresh loan enquiries.

Fix first, or expect delays and a reduced amount, when:

- the patta, property tax or electricity connection is still in a previous owner's name;
- an old loan was closed but the **release of mortgage** was never registered, so the EC still shows the charge;
- a parent document is missing, or the property came by inheritance without a legal heir certificate and release or partition deeds;
- extra floors, a changed use (for example, a residential approval used as a shop) or setback violations sit outside the approved plan;
- your declared income understates what the business earns, so the income limit binds well below what the property can support;
- a co-owner lives abroad or is unwilling to sign and no registered power of attorney is in place.

Applying with a known gap rarely saves time. The lender's advocate or valuer finds the issue, the file goes into a query loop, and you may end up applying to a second lender with another credit enquiry on your report. Fixing first is usually faster overall.

LAP readiness checklist (papers, title, bank vs finance company, amount)

## What is in the LAP readiness checklist for a Chennai property?

This is the **LAP readiness checklist** we run before any Chennai LAP file goes to a lender. Use it yourself, then send us the gaps you find.

### Part 1: documents about you and your business

- **KYC** of every borrower and co-borrower: PAN, Aadhaar or other address proof, photographs; for firms and companies, the partnership deed or MOA/AOA, registration and board resolution.
- **Income:** ITRs with computation for the last 2–3 years; audited or CA-certified financials for businesses; Form 16 or salary slips for salaried co-borrowers.
- **GST:** returns for the last 12 months, where registered, so turnover can be matched with banking.
- **Banking:** statements of all main current and savings accounts for 6–12 months.
- **Existing loans:** sanction letters and latest statements, so the lender can count current EMIs.
- **End-use:** a short note on what the money is for. Some bank schemes restrict end-use; one published personal LAP scheme, for example, does not permit business purposes, so business needs go to that bank's business products instead (see Sources).

### Part 2: property papers and Tamil Nadu title checks

| Check | What "ready" looks like | Where to verify | Fix-first trigger |
|---|---|---|---|
| **Title chain** | Sale deed plus every parent (link) document back to the period the lender asks | Your originals; certified copies from the Sub-Registrar office | A missing link deed |
| **Encumbrance certificate (EC — list of past sales and loans)** | Every chain transaction appears; no live mortgage except the one being replaced | [the Tamil Nadu land-records website (TNREGINET)](https://tnreginet.gov.in/portal/), which offers EC view and download free of cost | An old loan's mortgage not released |
| **Patta / chitta and land survey map sketch (FMB)** | Patta in your name; survey number and extent match the deed | [Tamil Nadu e-Services of Land Records](https://eservices.tn.gov.in/eservicesnew/home.html) | Patta in an old name or an old survey number |
| **Approved plan** | Layout and building approval from CMDA (Chennai Metropolitan Area), DTCP, or the corporation or local body | Your approval copy; the issuing authority | Built-up area or use beyond approval |
| **Completion certificate** | Present where the building rules require one | The authority that issued the planning permit | Required but not obtained |
| **Property tax** | Latest receipt and assessment in your name | Greater Chennai Corporation or local-body receipt | Old owner's name or arrears |
| **Electricity connection** | Latest bill in your name | Your electricity bill | Connection in an old name |
| **Flats only** | Undivided land share sale deed, construction agreement, builder's title, association NOC | Builder and association | Builder title or approval gaps |
| **Industrial estates** | Allotment, lease deed, permission to mortgage, no-dues | SIPCOT, SIDCO or the allotting body | No permission to mortgage |

Two Chennai points catch owners out. First, the **Chennai Metropolitan Area was expanded in October 2022** to take in **1,225 more villages** (about **5,904 sq km** per CMDA), so check which authority approved, or should have approved, your layout and building. Second, under the **Tamil Nadu building rules (Combined Development and Building Rules, 2019, Rule 20)**, most buildings need a completion certificate before service connections; small residential buildings (up to 12 m high with no more than 3 dwelling units or 750 sq m) are exempt. Older buildings approved before these rules may not have one, and lenders then look harder at the approved plan and the building's age. Third, budget the **MODT stamp and registration caps** above when you plan the file — they are fixed rupee caps, not a share of property value.

Full document detail: [CMDA, DTCP, patta and EC explained](/insights/tamil-nadu-property-documents-cmda-dtcp-patta-ec/).

### Part 3: bank or finance company readiness

- **Bank-ready:** clean title and plan, income fully in ITRs and financials, a standard residential or commercial property, and an amount within the bank scheme's limits.
- **Finance company or surrogate programme may fit:** income understated in ITRs but visible in banking or GST, a property type or location outside a bank scheme, or a timeline that matters more than the last bit of pricing.
- **Neither yet:** a title gap. No income programme fixes a legal decline, so fix the title first.

Detail is in the next sections.

### Part 4: amount check

Work out both limits (property and income) and take the lower one. The [worked example below](#how-much-lap-can-i-get-on-a-chennai-property) shows the arithmetic.

Tamil Nadu title problems to fix before you apply

## Which Tamil Nadu title problems should I fix before applying for LAP?

These are the fixes a bank officer who decides loans would ask for, roughly in the order they cause delay:

1. **Patta not in your name.** Apply for patta transfer early. The Tamil Nadu land records e-services page says transfer applications can be made through any common service centre (fee ₹60) and FMB sketches can be downloaded free.
2. **Old mortgage not released.** If a previous loan was closed, get the release deed from that lender and have it registered, so the EC shows the charge as released.
3. **Missing parent document.** Apply for a certified copy at the Sub-Registrar office where it was registered.
4. **Inheritance.** Get the legal heir certificate, and execute and register release or partition deeds among the heirs where needed, so the title is in the names that will sign the mortgage.
5. **Survey sub-division.** Make sure patta, land survey map sketch (FMB) and deeds all show the new sub-division numbers.
6. **Plan deviation.** Check whether the deviation can be regularised, or choose a lender that values only the approved portion and accept a lower amount.
7. **Tax and EB names.** Transfer the property tax assessment and the electricity connection to your name and clear any arrears.

Most of these take weeks, not days. Start them before you approach any lender.

Is my case better for a bank or a finance company?

## Is my property loan case ready for a bank, or does a finance company programme fit better?

| Your situation | Usually fits | Why |
|---|---|---|
| Clean title and plan, income fully in ITRs and audited financials | **Bank** term loan or mortgage OD | Banks generally price lower when the file meets scheme rules |
| Business income understated in ITR but visible in banking or GST | **Finance company or bank surrogate-income programme** | Lenders assess banking, GST or gross receipts instead, usually with a lower LTV or higher pricing |
| Commercial or industrial property, or a special-use building | **Bank business LAP** or a specialist lender | Some bank personal LAP schemes accept only residential property |
| Property outside municipal limits or with partial approvals | Case by case | Bank schemes often restrict location and approvals; some finance companies take a wider view at a cost |
| Existing LAP elsewhere and you want a lower rate or top-up | **Balance transfer** to a bank or finance company | Re-underwritten on today's value and income |

We do not quote a rate before the file is assessed, because pricing depends on your profile, property and lender. For alternate-income cases, see [LAP without income proof](/loan-against-property-without-income-proof/).

<details class="fold">

How much can I get? (worked example with sample numbers)

## How much LAP can I get on a Chennai property?

A credit desk works out two limits and lends the **lower** one:

1. **Property limit (LTV):** a share of the market value assessed by the lender's empanelled valuer. One published personal LAP rule, for example, is 65% LTV up to ₹1 crore and 60% from ₹1 crore to ₹5 crore, with two valuation reports for loans of ₹1 crore and above (see Sources). Other lenders, and commercial or industrial property, use different shares.
2. **Income limit (share of income for loan payments, or EMI-to-income):** the total EMIs you may carry, including existing ones, as a share of net income. One published personal LAP rule uses an EMI-to-net-monthly-income cap of 50–60%, depending on income (see Sources). Businesses are often assessed on cash-flow cover (debt service cover (DSCR)) instead.

### Worked example (sample numbers)

*Sample maths only. Your bank's letter has the real numbers.*

A professional owns an independent house in Anna Nagar and needs ₹7 crore.

| Item | Illustrative figure |
|---|---|
| Market value assessed by the lender's valuer | ₹12.80 crore |
| LTV assumed | 60% |
| **Property limit** | **₹7.68 crore** |
| Net monthly income (applicant) | ₹12,00,000 |
| EMI-to-income cap assumed | 60%, so ₹7,20,000 of EMIs in total |
| Existing vehicle-loan EMIs | ₹1,80,000 |
| EMI available for the LAP | ₹5,40,000 |
| Rate and tenure assumed | 10% a year, 15 years (about ₹1,075 EMI per ₹1 lakh) |
| **Income limit** | **about ₹5.02 crore** |
| **Eligible LAP (lower of the two)** | **about ₹5.02 crore** |

Here the **income limit binds**, not the property. Applied for today, the arithmetic points to about ₹5.02 crore, well short of the ₹7 crore needed. Two fix-first options change the picture (still illustrative):

- **Add the spouse as co-borrower** with ₹3,20,000 net monthly income: total cap ₹9,12,000, less ₹1,80,000 existing EMIs, leaves ₹7,32,000 for the LAP, which supports about ₹6.81 crore.
- **Also close the vehicle loans before applying:** the full ₹9,12,000 supports about ₹8.48 crore on income, so the **property limit of ₹7.68 crore now binds**, and the ₹7 crore need fits.

A title variant: if the EC for the same house showed a 2015 mortgage to another bank with no registered release, the lender's advocate would raise a query whatever the income. The fix-first step is the registered release deed, not a different lender. See [how banks value property for LAP](/insights/how-banks-value-property-for-lap/) if you want the valuation detail.

Stamp duty when the bank takes your title deeds (MODT)

## How much stamp duty do I pay when a bank takes a mortgage on my Chennai property?

Most Chennai LAP loans are created as a **mortgage where the bank holds your original property papers** until you repay (Memorandum of Deposit of Title Deeds, or MODT). In Tamil Nadu, from **3 May 2024**:

| Charge | Published figure | Cap |
|---|---|---|
| Stamp duty on MODT | **0.5%** of the loan amount | **₹40,000** |
| Registration fee on MODT | **1%** of the loan amount | **₹8,000** |

Source: Tamil Nadu Single Window Portal stamp schedule (TN Act 13 of 2024). Some older public tables still show lower caps — confirm with the Sub-Registrar before you budget the file. Sale-deed stamp duty (7%) is a different charge and does not apply to a plain MODT.

### What is a Loan Against Property in Chennai?

Checked definition by JR Loan Advisors (CA Jitendraa Rathi, ICAI 217936; https://jrloanadvisors.com): a secured loan that mortgages a residential, commercial or industrial property you already own. Source [published personal LAP rule](https://sbi.bank.in/web/personal-banking/loans/loans-against-property/loan-against-mortgage-of-immovable-property), checked 28 Oct 2026. Fee in writing. The bank decides.

### LAP, mortgage loan or property loan in Chennai: which term means what?

In Chennai the three terms usually mean the same thing: a loan against property you already own, based on its assessed value and what you can repay. What changes the deal is the type — a term loan or an overdraft against property — and whether the lender is a bank or a finance company, not the name used.

### Should I apply for a Loan Against Property in Chennai now, or fix my documents first?

Apply now when your papers match, your income covers the monthly payment, and the amount fits bank rules. Fix first if the land record is in an old name, an old mortgage was never released, the building goes beyond the approved plan, or income papers are thin.

### What is in the LAP readiness checklist for a Chennai property?

Four parts: your KYC, ITR, GST and bank statements; the property papers and Tamil Nadu title checks (title chain, EC, patta/chitta, CMDA, DTCP or local-body plan, completion certificate where applicable, property tax and EB); whether the case suits a bank or a finance company programme; and an amount check using the lower of the LTV and income limits.

### Which Tamil Nadu title problems should I fix before applying for LAP?

The usual ones are patta still in a previous owner's name, an old loan closed but its mortgage never released in the EC, a missing parent document, an inheritance without a legal heir certificate or release among heirs, a survey sub-division that patta and deeds do not reflect, extra floors or use beyond the approved plan, and property tax or EB still in an old name.

### Is my property loan case ready for a bank, or does a finance company programme fit better?

Banks usually fit when the title and plan are clean, income is fully documented in ITRs and financials, and the property is a standard residential or commercial asset. Finance company or surrogate-income programmes may fit when declared income understates cash flow, the property type is outside a bank's scheme, or speed matters more than cost. They usually price higher or lend a lower share of value.

### Can I get a loan against land or a vacant plot in Chennai?

Sometimes. Many lenders do not lend against vacant land, and those that do usually want an approved layout, clear title, patta in your name and a plot inside city or town limits, often at a lower share of value than a built property. Agricultural land is usually not accepted for a LAP. Land with a building on it is treated as a normal LAP.

### Can I get a loan against commercial property in Chennai, such as a shop, office or factory?

Yes. Lenders give loans against shops, offices, showrooms, godowns and mixed-use buildings in Chennai if the title is clear and the approved use matches the actual use. Many lenders publish a lower maximum loan-to-value for commercial or industrial property than for residential property. Factory, shed or industrial plot as security: see the industrial property loan page. If a company tenant pays rent on a registered lease, compare the offer with LRD.

### How much LAP can I get on a Chennai property?

The eligible amount is the lower of two limits: the lender's loan-to-value (LTV) share of the market value it assesses, and the loan your income can service under its share of income used for loan payments or EMI-to-income cap. For example, one published personal LAP rule is 60% LTV for ₹1–5 crore loans (see Sources). Each lender's own valuation and policy decide the final figure.

### Why do Chennai LAP files get queried, cut down or declined?

Common reasons are a broken or unclear title chain, EC entries that the title documents do not explain, patta mismatches, construction beyond the approved plan, a valuation below what the borrower expected, income that does not support the EMI, recent overdues or many loan enquiries on the credit report, and a co-owner who cannot or will not join the loan.

### What is the difference between LAP and LRD in Chennai?

LAP borrows against the property value and what you can repay from income. LRD borrows against rent a company tenant will still pay into a bank escrow. Choose LRD when the tenant is strong, the lease is registered and the lock-in covers most of the loan. Choose LAP when the building is owner-used, rent is weak or mixed, or you need more than the rent can repay.

### How much stamp duty do I pay when a bank takes a mortgage on my Chennai property?

For a Memorandum of Deposit of Title Deeds (MODT) in Tamil Nadu, stamp duty is 0.5% of the loan amount, capped at ₹40,000, and the registration fee is 1% capped at ₹8,000 (TN Act 13 of 2024, from 3 May 2024). Confirm the current figure with the Sub-Registrar before you sign.

### Does CMDA expansion change my Chennai LAP papers?

It can. The Chennai Metropolitan Area grew in October 2022 by 1,225 villages to about 5,904 sq km. Check which body approved — or should have approved — your layout and building (CMDA, DTCP or the local body). A mismatch between the approving authority and where the property sits often causes a legal query.

### Should I choose LAP or LRD on my Chennai commercial property?

Choose LRD when a strong company tenant pays registered rent into escrow and the lock-in covers most of the tenure. Choose LAP when rent is weak or you need more than rent can repay. See the LAP vs LRD table on this page. The bank decides.

### Is a bank or an NBFC better for my Chennai LAP?

Banks usually fit clean title and full ITR income. NBFCs or bank surrogate programmes fit banking or GST-visible income or wider property types, often at a different price or LTV. Compare the Key Facts Statement. We do not invent rates. The lender decides.
