# Which property papers does a bank ask for in Tamil Nadu?

> Banks in Tamil Nadu need your sale deed, a paper that lists past sales and loans (encumbrance certificate / EC), the land ownership record (patta), and approved building plans from the local planning body (CMDA in Chennai or DTCP elsewhere). Missing papers delay the loan.

In Chennai bank work, more good property loans were delayed by missing papers than by income. Tamil Nadu has several layers of land and building records. The bank's lawyer checks each layer. This guide explains what they look for and how to prepare. (General information only — not legal advice. For one property, ask a property lawyer.)

## Which documents form the "title chain"?

The **title deed** (sale deed, gift deed, settlement deed, partition deed or release deed) proves how you acquired the property. The **parent documents** (link documents) prove how each previous owner acquired it, going back typically 30 years or more as per the lender's legal policy. The lender's advocate reads them in sequence to confirm an unbroken chain of ownership.

Common breaks in the chain:

- A missing deed for one transfer in the chain.
- Ownership by **inheritance** without proper legal heir documentation, or without all heirs joining a release or partition.
- **Power of attorney** sales without a registered conveyance by the owner.
- **Discrepancies** in extent, survey number or boundaries between deeds.
- Prior mortgages not cleared in the records.

## What is an encumbrance certificate (EC), and how many years back must it go?

An EC shows registered transactions — sales, mortgages, releases, leases — against a property during a period. Lenders compare the EC with the title chain: every transaction in the chain should appear, and there should be no unexplained mortgage or sale. In Tamil Nadu, ECs are obtained through the Registration Department's online portal (TNREGINET) for available periods and through the Sub-Registrar office for others. Lenders commonly ask for 13 to 30 years depending on policy.

Watch for: an existing mortgage that was closed but never released in the records; entries under an old survey number after a sub-division; and transactions in the names of previous owners after they supposedly sold.

## What are patta, chitta and adangal?

These are **revenue records** maintained by the Revenue Department:

- **Patta** — the record of rights showing who holds the land, with survey number and extent.
- **Chitta** — historically a related record of land ownership and classification (now largely merged into patta records online).
- **Adangal** — the village account record of land use and classification.
- **Land survey map sketch (FMB)** — the field measurement book sketch of the survey number's boundaries.

Lenders expect patta in the current owner's name, matching the survey number and extent in the sale deed. Patta transfer after purchase is often overlooked; apply early. Land classified as government land (such as poramboke) or restricted categories is generally not acceptable as security.

## What approvals must the building have?

| Area | Approving authority (typical) |
|---|---|
| Chennai Metropolitan Area | CMDA for layouts and larger buildings; Greater Chennai Corporation and local bodies for smaller buildings within delegated powers |
| Rest of Tamil Nadu | DTCP and local planning authorities for layouts and larger buildings; municipalities and panchayats for smaller buildings within delegated powers |

Lenders look for the **approved layout** (for plots and independent houses), the **approved building plan**, and — for buildings above specified thresholds — a **completion certificate**. The bank's technical valuer then checks whether the construction matches the plan. Common problems: additional floors beyond approval, setback violations, and commercial use of a residential approval. Depending on the extent, lenders may decline, reduce the value, or consider only the approved built-up area.

## What is guideline value and why does it matter?

The **guideline value** is the minimum value per unit area fixed by the Tamil Nadu Registration Department for stamp duty and registration purposes. It is revised from time to time. Banks lend on **market value** assessed by their valuers, but they record guideline value too. If your claimed market value is many times the guideline value, or the registered sale value was much lower than the current valuation, expect questions.

## What other documents do lenders ask for?

- Latest **property tax** receipt and assessment.
- **Electricity** (EB) bill in the owner's name.
- For apartments: builder agreement, sale deed for the **undivided share (UDS)** of land, construction agreement, association NOC, occupancy/completion certificate.
- For industrial plots in SIPCOT or SIDCO: allotment order, lease deed, permission to mortgage, no-dues from the allotting authority.
- For rented property: lease deeds and tenant details.

## How is the mortgage created?

Most LAP loans use an **mortgage where the lender keeps your original property papers until the loan is closed (equitable mortgage by deposit of title deeds)**, recorded through a **Memorandum of Deposit of Title Deeds (MODT)** registered with the Sub-Registrar, with stamp duty and registration charges payable as per Tamil Nadu rules. The bank holds the original documents until the loan is closed; on closure, you receive the documents back and the release is recorded.

## What problems should you fix before applying?

1. **Patta not in your name** → apply for transfer now.
2. **Missing parent document** → obtain certified copies from the Sub-Registrar office.
3. **Inheritance without legal heir certificate** → obtain it, and execute release or partition deeds among heirs if needed.
4. **Old mortgage not released** → obtain a release deed and register it.
5. **Building deviation** → assess regularisation possibilities or choose a lender that values only the approved portion.
6. **Survey number sub-division** → ensure patta, FMB and deeds match the new numbers.

## How do apartments differ from independent houses?

For a flat, you own an **undivided share (UDS)** of the land plus the built-up unit. Lenders check the undivided land share sale deed, the construction agreement or sale deed for the unit, the builder's title to the land (often through the builder's own title chain and joint development agreement), building approval from CMDA or DTCP/local body, and the completion or occupancy certificate. For older apartments, the residual life of the building affects tenure and valuation. Patta for the land is often in the name of the original landowner or held jointly; lenders accept this subject to their legal policy, but sub-division of patta in favour of flat owners, where available, strengthens the file.

## What extra checks apply to commercial and industrial property?

Commercial property must have approval for commercial use, and the lender checks that the use matches the approval. Industrial property may need factory licences, pollution control board consents and, for leasehold industrial estates such as SIPCOT or SIDCO, the allotting authority's permission to mortgage and confirmation of no dues. Special-use buildings — hospitals, schools, hotels — attract lower LTVs because they are harder to sell, and lenders check sector licences too.

## How long does legal clearance usually take?

For a property with a clean, complete set of documents, the lender's advocate typically issues the legal scrutiny report within a week or two of receiving documents. Cases with missing parent documents, pending patta transfer or inheritance issues can take weeks or months — which is why we check documents before the file is logged in, not after.

## How we help

Before your file reaches a bank, we run a pre-legal check of your title chain, EC, patta and approvals, flag issues that would stop a sanction, and coordinate with your lawyer to fix them. Then we pick a lender whose legal policy suits your property. This is a large part of why our cases move faster. For Chennai collateral cases, start with the [LAP readiness checklist](/loan-against-property-chennai/#what-is-in-the-lap-readiness-checklist-for-a-chennai-property) on the [loan against property in Chennai](/loan-against-property-chennai/) hub, then see [Loan Against Property](/services/loan-against-property/) or WhatsApp +91 94450 93336.

## Frequently asked questions

### How many years of EC do banks ask for in Tamil Nadu?

It depends on the lender's legal policy; commonly 13 to 30 years. Encumbrance certificates can be obtained online through the Tamil Nadu Registration Department's portal (TNREGINET) for the periods available there.

### Is patta mandatory for a home loan or LAP?

For land and independent houses, lenders expect patta in the current owner's name or proof that transfer is in process. For apartments, lenders rely more on the undivided share in the land and the building approvals, though a patta for the land is still reviewed where available.

### What is the difference between CMDA and DTCP approval?

CMDA (Chennai Metropolitan Development Authority) is the planning authority for the Chennai Metropolitan Area. DTCP (Directorate of Town and Country Planning) and local planning authorities approve layouts and buildings in the rest of Tamil Nadu, with local bodies handling smaller buildings within delegated limits.

### Can I get a loan on an unapproved plot?

Most banks decline unapproved, unregularised plots. If the plot has been regularised under the applicable Tamil Nadu regularisation scheme, some lenders consider it, often at a lower loan-to-value.

### Does the bank use guideline value for my loan?

Banks lend based on market value assessed by their valuers, but they record the guideline value fixed by the Tamil Nadu Registration Department. A market value far above guideline value is examined more closely.
